Manta Organics – Terms & Conditions

By accessing or purchasing from Manta Organics, you agree to these Terms & Conditions in full. If you do not agree with any part of these terms, please refrain from using the website or purchasing our products. These Terms, along with our Shipping Policy and Refund & Returns Policy, govern your relationship with Manta Organics.

1. Eligibility and Age Requirements

Manta Organics products are available to all customers. If you are under the age of 18, you must have the consent of a parent or guardian to make a purchase. By completing an order, you confirm that you either meet the age requirement or have received appropriate permission to enter into this agreement.

2. Products, Pricing, and Availability

Our product range includes cosmetics, makeup tools such as brushes and spatulas, and related items. While every effort is made to ensure accuracy in product descriptions, pricing, and images, slight variations may occur due to the natural ingredients used or differences in monitor or device displays. We reserve the right to modify, discontinue, or update products at any time without prior notice.

All prices are displayed in Australian dollars (AUD) and include GST where applicable. Prices may change without notice. The price charged for your order is the price displayed at checkout.

3. Order Acceptance and Payment

Orders are accepted subject to availability and the discretion of Manta Organics. Payment can be made via PayPal, Afterpay, Visa, and major credit cards. By submitting an order, you confirm that all information provided is accurate and that the payment method is valid. We reserve the right to refuse or cancel any order in the event of suspected fraud, unavailable stock, or other reasons determined at our discretion.

4. Shipping, Delivery, and Risk

All orders are processed within 1–5 business days, excluding unforeseen interruptions. Estimated delivery times within Australia are 3–8 business days after dispatch, depending on your location. Free shipping applies to orders over $140 AUD. Customers will receive a tracking email once the order has been dispatched.

Delivery Liability: While we make every effort to ensure timely delivery, Manta Organics is not liable for delays caused by couriers, weather, natural disasters, public holidays, or other events beyond our control. Customers must provide accurate shipping information, and Manta Organics is not responsible for parcels lost or misdelivered due to incorrect addresses. Similarly, we are not responsible for loss, theft, or damage to parcels once they have been marked as delivered by the courier.

5. Returns, Refunds, and Exchanges

Returns and refunds are only available for damaged, incorrect, or unopened products within 14 days of receipt. Opened, used, or change-of-mind returns are not accepted due to hygiene and safety considerations.

• Refunds for damaged items are issued to the original payment method once the item has been returned.

• Incorrect items can be replaced or exchanged for store credit, at the customer’s choice.

• Return postage for damaged or incorrect items is covered by Manta Organics.

To initiate a return, customers must email manta.organicshq@gmail.com with their order number and a photograph demonstrating the issue. Refunds are processed within 5–10 business days after the returned item has been received and inspected.

6. Product Disclaimers, Health, and Assumption of Risk (Crucial Protection)

Manta Organics products may contain natural ingredients. Customers are advised to perform a patch test prior to use.

Intellectual Property: All content on this website, including text, images, branding, and design, is owned by Manta Organics and protected by copyright and intellectual property laws. You may not reproduce, distribute, or otherwise use this content for commercial use without prior written permission. you may share content for personal/online use if Manta Organics is mentioned. 

Privacy: Any personal information collected during the purchasing process is handled in accordance with our separate Privacy Policy. By using the website, you consent to the collection and use of your information as described in that policy. we do not use your information publicly. 

Third-Party Links: Our website may contain links to third-party websites or services that are not owned or controlled by Manta Organics. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any such third-party websites or services. Accessing these links is at your own risk.

8. Force Majeure

Manta Organics shall not be liable for any failure or delay in the performance of our obligations under these Terms due to events beyond our reasonable control (Force Majeure), which may include, but are not limited to, acts of God, war, terrorism, labour disputes, natural disasters, pandemic or epidemic events, or failure of utility service or transportation. We will use commercially reasonable efforts to minimise the impact of any such event.

9. Limitation of Liability and ACL

Australian Consumer Law (ACL): Our policies are in addition to your rights under Australian Consumer Law, which cannot be excluded. Nothing in these Terms attempts to exclude, restrict, or modify any non-excludable condition, warranty, guarantee, right, or remedy conferred on you by the ACL or any other applicable law.

Limitation of Liability: To the maximum extent permitted by law (including the ACL), Manta Organics will not be liable for any direct, indirect, incidental, punitive, or consequential loss or damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, or loss of data, arising from your use of the website or any products procured using the service.

Where Manta Organics is permitted to limit its liability under the ACL, our liability is limited to either (a) replacement of the goods or the supply of equivalent goods, (b) repair of the goods, (c) payment of the cost of replacing the goods or acquiring equivalent goods, or (d) payment of the cost of having the goods repaired, at our election.

10. Indemnification

You agree to indemnify, defend, and hold harmless Manta Organics, its directors, officers, employees, and affiliates, from and against any and all claims, liabilities, damages, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms & Conditions; (b) your violation of any law or the rights of a third party; or (c) any third-party claims arising from your improper or irresponsible use of the Manta Organics products.

11. Governing Law and Amendments

Governing Law: These Terms are governed by the laws of Australia, and any disputes arising from them are subject to the exclusive jurisdiction of Australian courts.

Amendments: Manta Organics reserves the right to amend or update these Terms & Conditions at any time. Such updates take effect immediately upon being posted to the website. Continued use of the website or purchase of products constitutes acceptance of any changes.
